TERMS & CONDITIONS

1. PRELIMINARY CLAUSES

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Participant,” “you”) and XINSIDER FZCO, operating under the brand name XINSIDER (“XINSIDER,” “we,” “us”). By accessing or using the XINSIDER platform, you acknowledge that you are at least 18 years of age and legally competent to enter into binding contracts in your jurisdiction. XINSIDER services are not available to residents of jurisdictions where participation would violate local laws or regulations, including but not limited to sanctioned territories.

2. ORDERS AND PROVISION OF SERVICES

To access XINSIDER’s evaluation programs, you must register an account and select a Challenge or Instant Funding product. Upon placing an order and completing payment, XINSIDER will provision your simulated trading account within the timeframe specified for your selected product. You are solely responsible for ensuring the accuracy and completeness of all data submitted during registration, including your legal name, email address, and country of residence. Inaccurate or fraudulent information may result in immediate account termination without refund.

3. USER SECTION AND TRADING PLATFORMS

Upon provisioning, you will receive login credentials for a supported third-party trading platform (e.g., TradeLocker, MetaTrader 5, Bybit). You are responsible for maintaining the confidentiality of your credentials and for all activity conducted under your account. XINSIDER reserves the right to suspend or terminate your account at any time for breach of these Terms, suspicious activity, or at our sole discretion. You may not transfer, sell, or share your trading account or credentials with any third party.

4. APPLICABLE FEES AND PAYMENT

All fees for evaluation programs, activation fees for funded accounts, and any ancillary charges are displayed on the XINSIDER platform at the time of purchase. Fees are non-refundable except as expressly stated in our Refund Policy. Prices are listed in the applicable currency and may be subject to currency conversion fees charged by your payment provider. XINSIDER accepts payment via credit/debit cards, cryptocurrency, and other payment methods as made available on the platform.

5. PROHIBITED BEHAVIOUR

Participants are strictly prohibited from engaging in market manipulation, latency arbitrage, high-frequency trading (HFT) designed to exploit system infrastructure, abusive hedging across multiple accounts, copy trading from third-party signal providers, or any strategy intended to circumvent evaluation rules rather than demonstrate genuine trading skill. Use of automated trading bots or expert advisors is permitted only where expressly authorized in your product terms. Any violation of this section may result in immediate disqualification, account closure, and forfeiture of any pending rewards without prior notice.

6. CHALLENGES AND INSTANT FUNDING

XINSIDER offers multi-phase Challenge evaluations and single-phase Instant Funding products. Each product defines specific performance targets, drawdown limits, and trading day requirements that must be met to advance to the next phase or receive a funded account. Activation fees may be required before a funded account is provisioned. Performance assessment is conducted automatically by the XINSIDER platform and is subject to verification and audit by our compliance team prior to any reward disbursement.

7. INTELLECTUAL PROPERTY

All content, software, trademarks, logos, and other materials on the XINSIDER platform are owned by or licensed to XINSIDER FZCO. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for its intended purpose. You may not reproduce, distribute, modify, reverse-engineer, decompile, or create derivative works based on any part of the XINSIDER platform or its underlying technology without express written consent.

8. DISCLAIMERS AND LIABILITY

The XINSIDER platform and all associated services are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied. XINSIDER does not guarantee uninterrupted access, error-free operation, or specific trading outcomes. To the maximum extent permitted by applicable law, XINSIDER’s total aggregate liability for any claims arising from your use of the platform shall not exceed the total fees paid by you to XINSIDER in the twelve (12) months preceding the event giving rise to the claim.

9. DURATION OF CONTRACT

These Terms remain in effect for the duration of your active evaluation or funded account. The contract terminates automatically upon completion, failure, or expiration of your trading challenge, or upon closure of your account. Where applicable under your jurisdiction, you may exercise a right of withdrawal within 14 days of purchase, provided that the evaluation account has not been provisioned or accessed during that period.

10. COMMON PROVISIONS

Any material breach of these Terms may result in immediate termination of your account and forfeiture of any pending rewards. XINSIDER may communicate with you via email, platform notifications, or other electronic means at the contact information associated with your account. Any complaints or disputes should be directed to [email protected] and will be addressed within a reasonable timeframe in accordance with our complaint handling procedures.

11. US-SPECIFIC PROVISIONS

For Participants located in the United States: any dispute arising from or relating to these Terms shall be resolved through binding arbitration administered in accordance with the rules of a recognized arbitration body. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. This arbitration clause shall survive termination of these Terms and your use of the XINSIDER platform.

12. OTHER JURISDICTIONS

Additional provisions may apply to Participants in certain jurisdictions. For Australia, the Australian Consumer Law may provide certain guarantees that cannot be excluded. For Canada, Participants in Quebec may have additional rights under consumer protection legislation. For Japan, the Act on Specified Commercial Transactions may impose additional obligations. For the United Kingdom and European Union, statutory rights under local consumer protection law are not affected by these Terms.

13. FINAL PROVISIONS

These Terms constitute the entire agreement between you and XINSIDER regarding the subject matter hereof and supersede all prior agreements, understandings, and representations. The failure of XINSIDER to enforce any provision of these Terms shall not constitute a waiver of that provision. XINSIDER may assign its rights and obligations under these Terms to any affiliate or successor entity without your consent. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
